LEGAL

Terms of Service

Effective October 11, 2026 · Policy Version 2026-10-11

1. Agreement

These Terms govern purchases and use of Nutrixo services. Nutrixo is operated by MDP Messenger and Freight Transport Corp. By placing an order or starting a subscription, you agree to these Terms, the Privacy Policy, and the Refund & Cancellation Policy.

2. Orders and availability

Orders are subject to acceptance, payment authorization, delivery availability, ingredient availability, and operational capacity. Nutrixo may reject, limit, or cancel an order when reasonably necessary, including for pricing errors, suspected fraud, inability to fulfill, or circumstances outside reasonable operational control. When Nutrixo cancels a paid order that will not be fulfilled, the applicable amount will be handled as required by law.

3. Weekly cutoff

The weekly order, change, skip, and cancellation cutoff is Friday at 2:00 PM Eastern Time. Orders or requests received after the cutoff are scheduled for the next available delivery cycle.

Additional details are contained in the Refund & Cancellation Policy.

4. Subscriptions and recurring billing

Weekly subscriptions automatically renew each billing cycle until canceled. By purchasing a subscription, you authorize Nutrixo and its payment processor to automatically charge the payment method on file for the applicable plan, selected extras, delivery, taxes, and other amounts disclosed at checkout.

Requests to change, skip, or cancel a subscription or upcoming order must be submitted through Nutrixo support by email at order@nutrixomeals.com or by phone at (954) 787-1265. Cancellation affects eligible future renewals and does not automatically reverse an order that has already renewed, been processed, or passed the applicable cutoff.

5. Prices, delivery fees, and taxes

Prices may vary by plan and product. Delivery charges are separate from meal prices unless expressly stated otherwise. Applicable taxes and the final amount due are presented during checkout.

6. Delivery

Customers are responsible for providing an accurate, accessible, and complete delivery address and any necessary instructions for gates, buildings, reception areas, or other access points.

Delivery estimates may be affected by traffic, weather, access restrictions, production timing, emergencies, or other conditions. Nutrixo does not guarantee an exact delivery minute unless expressly agreed in writing.

7. Delivery after drop-off

An order is considered delivered when it is reasonably delivered to the address, door, reception area, lobby, designated drop-off location, or other location authorized by the customer or supported by the customer's delivery instructions.

After delivery, the customer is responsible for promptly retrieving, refrigerating, storing, reheating, and handling the food appropriately.

8. Dietary preferences, exclusions, and allergens

Nutrixo may offer meal styles, preferences, and ingredient exclusions. These selections are intended to help personalize an order but are not medical advice.

Unless Nutrixo expressly states otherwise for a particular product, preference or exclusion selections should not be treated as a guarantee that a meal is free from a particular allergen or trace exposure. Customers with severe allergies or medical dietary requirements should contact Nutrixo before ordering and should not rely solely on preference or exclusion controls.

9. Food information

Menu descriptions, photographs, serving presentations, ingredient information, and other product information are provided for general informational purposes. Actual presentation and available ingredients may vary reasonably while maintaining the nature of the ordered product.

10. Customer responsibilities

You agree to provide accurate account, contact, order, payment, and delivery information and to use Nutrixo services only for lawful purposes.

11. Refunds and claims

Refunds, credits, replacements, cancellations, and claims are governed by the Refund & Cancellation Policy, which is incorporated into these Terms.

12. Website availability and errors

Nutrixo does not guarantee that the website will always be uninterrupted or error-free. We may correct typographical, pricing, technical, availability, or other errors and may update the website as reasonably necessary.

13. Intellectual property

Nutrixo names, branding, website design, text, graphics, images, and other original content are protected by applicable intellectual property laws and may not be copied or commercially reused without authorization except as permitted by law.

14. Limitation of liability

To the fullest extent permitted by applicable law, Nutrixo and MDP Messenger and Freight Transport Corp. will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of the website, products, deliveries, or services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

15. Events outside reasonable control

Nutrixo is not responsible for delays or failures caused by events outside its reasonable control, including severe weather, road closures, governmental action, utility or network interruptions, supply disruptions, emergencies, or similar events.

16. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.

17. Changes to these Terms

Nutrixo may update these Terms prospectively. The effective date shown above identifies the version presented for acceptance.
